Tristan Joe was 30-years-old and Raine Silas was 18-years-old when the incident occurred.
Tristan Joe has been given a four-and-a-half-year sentence which includes time already served for his role in the manslaughter of Raine Silas.
Joe pleaded guilty to a lesser charge of manslaughter earlier this year due to being intoxicated during the time of the incident.
Joe was 30-years-old when the incident occurred while Silas was 18-years-old.
The sentencing occurred in Pelly Crossing on Tuesday at 11 am at the Pelly Crossing Community Hall.
In a statement, April Baker had this comment on the sentencing that occurred yesterday.
“I feel like the justice system has failed us. I thought it wasn’t fair Tristan got to use the Gladeau report. People feel the whole defense was a complete lie. Raine didn’t even have time to defend himself when he was struck, he didn’t even see it coming. Tristan suggests he doesn’t remember using that weapon, I believe he does remember. I almost collapsed when I rushed out of the building when the sentence was given. My best friend was standing outside the door and grabbed me while falling… I collapsed into her arms and cried out uncontrollably.”
The Gladue report was also used in the manslaughter case, which gives more consideration for sentencing if the offender is of First Nations descent.
Approximately 60 people attended the sentencing, and conditions in Joe's sentencing are a ten-year firearm prohibition, an ordered body DNA analysis, a no-contact list with 40 people in the community along with those who provided a victim-impact statement, and refraining from purchasing or the consumption of alcohol.
A curfew will also be put into place during Joe's probation which will be monitored by his probation officer.
