First Nation went to court seeking permission to remove Tim Smith's unwanted property from Lot 226.
The Kwanlin Dun First Nation is now able to clear personal property from its land in the Marwell area of Whitehorse.
The First Nation was granted a court order to remove the property of Tim Smith from Lot 226.
Smith will be allowed one week to any of his contents off the land, failing to do so, will give Kwanlin Dun the right to dispose of any remaining property.
The Yukon Supreme Court has also ruled that Smith has trespassed and can be arrested if he breeches the order.
Court documents suggest that Smith is using the land to store vehicles and other possessions.
The First Nation says it has been advising Smith since 2013 to remove his property.
Kwanlin Dun has developed a draft plan for the land, which includes commercial activity.
