Duke Beattie seeking unspecified damages following beating in back of cruiser in May 2015
Duke Beattie of Carcross is suing the police officer who assaulted him, Constable Daniel Rouleau the RCMP and the Attorney General. Beattie’s lawsuit filed in Yukon Supreme Court alleges malicious prosecution in that his Charter rights were violated.
The suit stems from a May 2015 incident where Beattie was assaulted by Constable Jason Potter while handcuffed in the back of a cruiser.
Beattie's suit states that while being transported to Whitehorse after being arrested on alcohol charges, Potter stopped the vehicle, entered the backseat punched Beattie several times and threatened to kill him.
Potter pleaded guilty to the charges and was given a conditional sentence, probation and community service.
While the incident was recorded on RCMP vehicle cameras, the officers claim prior to the assault, Beattie threatened Potter and his family.
Yet the officer’s assertions could not be proven because the audio quality of the recording was very poor.
Beattie denies the officers claims. He is seeking damages and court costs.
